  1. END USER LICENSE AGREEMENT 
  2.  
  3. This is a legal agreement between you and Urikiri-Shashin-Kan, Inc. (Royalty Free
  4. Picture House).   In using the images from the Urikiri-Shashin-Kan, Inc. collection
  5. you agree to be bound by all the terms and conditions of this agreement. 
  6.  
  7. 1. License Grant 
  8. All images from the Urikiri-Shashin-Kan, Inc. collection are proprietary and 
  9. copyrighted.   All rights are reserved by Urikiri-Shashin-Kan, Inc..   This license is
  10. granted only to the registered owner of a Urikiri-Shashin-Kan, Inc. CD-ROM.   Your
  11. invoice is the proof of your registration.   This license is valid with respect to
  12. the images you have purchased and only if you have paid the applicable fee.   No
  13. rights may be granted to the images other than the right to use the images as 
  14. part of a design.   Urikiri-Shashin-Kan, Inc. reserves the right to
  15. discontinue the use of any image and to replace it with an alternative image.
  16. Upon notification of the discontinuance of the right to use a particular image,
  17. you agree not to use the image in the future and to discontinue using it.

  19. 2. Permitted Usage 
  20. By this agreement, Urikiri-Shashin-Kan, Inc. grants to you (the registered user) the 
  21. non-exclusive, non-transferable right to use the images in advertising and 
  22. promotional materials for you or your direct clients or customers, who must be the 
  23. end-user.   Examples include: advertisements, articles in magazines and newspapers, 
  24. reports, brochures, books, newsletters, multimedia applications, packaging, the 
  25. internet.   All equipment accessing the images must be at one physical location and 
  26. be operating under one organization.

  28. 3. License Restrictions 
  29. You may not:
  30.  
  31. *Copy or distribute copies of the software, documentation or the package to 
  32. others. 
  33. *Sub-license, sell, re-sell, distribute, give away, lend, rent, lease or 
  34. provide to others any portion of the images from the CD-ROM. 
  35. *Use any image from the CD-ROM in any form of pornography, or in any other 
  36. manner which is in any way embarrassing to or defamatory of any person or entity
  37. or  otherwise unlawful. 
  38. *Use images with logos or trademarks without authorization from the 
  39. depositary of the logo or trademark. 
  40. *    Automatically use the images in products for resale in quantities greater than 100.000.  
  41. For such use you must acquire an Extended Usage License from Urikiri-Shashin-Kan, Inc.
  42. *    Automatically use the images for calendars, postcards, posters and framed prints 
  43. intended for resale.  For such use you must acquire an Extended Usage License from 
  44. Urikiri-Shashin-Kan, Inc.
  45. *Copy the images to a network, electronic bulletin board or on-line service.  The
  46. images cannot be in a downloadable or FTP format.  It is allowed to use the images
  47. as a part of a design for the internet.

  49. 4. Warranties 
  50. Urikiri-Shashin-Kan, Inc. warrant that it has the right to grant this license to you
  51. and to the best of its knowledge, the images do not infringe any rights of copyrights
  52. or other intellectual property or proprietary rights of third parties, but no right of
  53. action shall accrue against Urikiri-Shashin-Kan, Inc. in the event of the said images
  54. being found infringing third party rights. 
  55. Model releases are not available for the images in this disk
  56. Urikiri-Shashin-Kan, Inc. also warrants that the CD-ROM
  57. disc is free from defects in materials and workmanship for 90 days following the
  58. receipt of the product.  The images are provided as is.   Urikiri-Shashin-Kan, Inc. 
  59. makes no warranty of any kind on the quality of the images or compatibility with
  60. other computer products.   Your sole remedy against Urikiri-Shashin-Kan, Inc. shall
  61. be limited to replacement of the CD-ROM.   Neither Urikiri-Shashin-Kan, 
  62. Inc., nor its licensors will be liable to you for any consequential, incidental, 
  63. direct, indirect or other damages arising out of the license of the image including 
  64. any lost profits or any claim of a third party.

  66. 5. General 
  67. All rights to this CD-ROM and the images are owned by Urikiri-Shashin-Kan, Inc. and its 
  68. licensors and are protected by international copyright laws, international treaty 
  69. provisions and other applicable laws. You must treat the images like any other 
  70. copyrighted material, except to the extent that this license provides to the contrary.   
  71. Urikiri-Shashin-Kan, Inc. retains the rights not expressly granted by this agreement.   
  72. Your right to use the images terminates automatically if you violate any part of this 
  73. license.   In the event of termination, you must immediately destroy all copies of 
  74. the images and return the CD-ROM(s) to Urikiri-Shashin-Kan, Inc.   You may be held 
  75. legally responsible for any copyright infringement that is caused or encouraged by 
  76. your failure to abide by the terms of this agreement.   If any provision of this 
  77. agreement is held invalid, the remainder of this agreement shall continue in full 
  78. force and effect.   In case of any problems, the court of Tokyo, Japan, will have
  79. exclusive jurisdiction.
